Our services are available to individuals and businesses in Malaysia and, where appropriate, in cross-border matters involving Malaysian interests.
The information presented on our website is for general informational purposes and does not constitute legal advice. A formal solicitor-client relationship is only established upon the execution of an engagement letter or equivalent written agreement.
4. User Responsibilities
When using our website or engaging our services, you agree to provide accurate and complete information when submitting enquiries or documents, to use our website for lawful purposes only, to refrain from attempting to disrupt or interfere with the website's operation, and to respect the intellectual property rights associated with our website content.
You must not use our website to transmit any harmful, misleading, or unlawful content, or to attempt to gain access to restricted areas of the website or our systems.
5. Intellectual Property
All content on this website, including text, graphics, logos, and design elements, is the property of brevelles or its licensors and is protected under Malaysian intellectual property law. You are granted a limited, non-exclusive, non-transferable licence to access and view the website content for personal, non-commercial use only.
6. Payment Terms
Fees for our services are denominated in Malaysian Ringgit (RM) and will be agreed upon in writing before any work commences. Payment terms, including due dates and accepted methods, will be specified in the engagement letter for each matter.
Where a fixed fee has been agreed, that fee applies to the defined scope of work. Any additional work requested beyond the original scope may be subject to additional fees, which will be communicated and agreed before the work is performed.
Late payments may be subject to interest at the rate specified in the engagement letter or, where no rate is specified, at the prevailing statutory rate.
7. Service-Specific Terms
Technology & Digital Business Law: Advisory on regulatory matters is based on the legislation in force at the time the advice is given. Regulatory environments change, and advice may require updating as new laws or guidelines are introduced.
Environmental & Land Use Advisory: Outcomes of applications to government authorities (e.g., DOE, state land authorities) are subject to the discretion of those authorities. We will advise on the process and prepare submissions to the highest standard, but we cannot control regulatory decisions.
Alternative Dispute Resolution: The outcome of mediation and arbitration proceedings depends on the facts, the strength of the case, and the decisions of mediators or arbitrators. We will provide diligent representation, but outcomes cannot be predetermined.
8. Disclaimers
Our website and its content are provided on an "as is" basis. While we make every effort to ensure the accuracy and relevance of the information presented, we do not warrant that the content is error-free, comprehensive, or suitable for any particular purpose.
Nothing on this website should be construed as a promise or representation regarding the outcome of any legal matter. Each matter is unique, and results depend on a range of factors specific to the circumstances involved.
9. Limitation of Liability
To the fullest extent permitted by Malaysian law, brevelles shall not be liable for any indirect, incidental, consequential, or special damages arising from or in connection with the use of our website or services. Our total liability for any claim arising from an engagement shall not exceed the total fees paid by you for the specific matter giving rise to the claim.
Nothing in these terms limits our liability for fraud, wilful misconduct, or any other liability that cannot be lawfully excluded.
10. Indemnification
You agree to indemnify and hold brevelles harmless from any claims, losses, or damages (including legal costs) arising from your breach of these Terms, your misuse of our website, or any inaccurate information you provide to us.
11. Termination
Either party may terminate a service engagement in accordance with the terms of the engagement letter. Upon termination, you remain responsible for any fees accrued up to the date of termination.
We reserve the right to restrict or terminate access to our website at any time, without prior notice, for any user who violates these Terms.
12. Governing Law and Dispute Resolution
These Terms and Conditions are governed by the laws of Malaysia. Any dispute arising from or in connection with these Terms shall first be subject to good-faith negotiation between the parties.
If the dispute cannot be resolved through negotiation within 30 days, either party may refer the matter to mediation at the Asian International Arbitration Centre (AIAC) in Kuala Lumpur. If mediation does not result in a resolution, the courts of Malaysia shall have jurisdiction over the matter.
13. General Provisions
Entire Agreement: These Terms, together with our Privacy Policy and any engagement letter, constitute the entire agreement between you and brevelles in relation to the use of our website and services.
Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
Waiver: Our failure to enforce any provision of these Terms does not constitute a waiver of that provision.
Assignment: You may not assign or transfer your rights under these Terms without our prior written consent.
